First-Time Login Agreement

DISTRIBUTORSHIP REQUIREMENTS - You must be at least 18 years of age and be a Malaysian citizen or Permanent Resident. Distributors may sign up individually or jointly with their spouse. Spouse may not have separate Distributorship.

ID NUMBER - Your Shaklee ID No. should be used for all communications with Shaklee Products (Malaysia) Sdn Bhd, including sponsorship.

SPONSORSHIP - I/We agree and adhere to:-
1) Shaklee P&R under Section 2 becoming a Distributor
2) Section 7 on Reorganization and Termination

DISTRIBUTING AND SELLING PRODUCTS - Approved applicants may call themselves Shaklee Independent Distributors and are authorized to sell Shaklee products to others. Because Shaklee is a direct selling company, Distributors may not sell Shaklee products directly or indirectly to or from retail stores and unauthorized on-line retail portals.

UNAUTHORIZED CLAIMS AND PRACTICES - Distributors may not make unauthorized claims about Shaklee products or Compensation Plan that are contrary to literature that has been published by Shaklee. Distributors are strongly encouraged to be compliant to the laws of Malaysia, Shaklee Code of Conduct and the Statement of Privileges and Responsibilities. Shaklee reserves the right to take corrective action against Distributors who are found not compliant, which may include business suspension, withdrawal of bonuses, invitations to trips or conferences, and/or termination.

INDEPENDENT CONTRACTOR STATUS - Distributors are Independent Contractors. Distributors are not employees, legal representatives, or agents of Shaklee, or of any other Independent Shaklee Distributorship. Distributors, therefore, are not treated as employees for purposed of income tax withholding, labor laws, or any other laws covering employees.

AGREEMENT - Shaklee Compensation Plan, Business Guide, P&R and other Shaklee publications shall constitute a part of this agreement. I/We acknowledge receipt of Shaklee Starter Kit and other Shaklee publications which are hearby incorporated by reference and agree to abide by all the terms and conditions in these publications.

CANCELLATION OF AGREEMENT - I/We may opt to cancel this agreement by notifying Shaklee in writing within a period of not less than ten (10) working days from the date of signing up. The signing up fee refund will be made upon cancellation of my/our distributorship subject to the return of Shaklee Starter Kit and other Shaklee related publications. I/We agree that refund of fee is not applicable on any free sign-up promotion(s).

ANNUAL SUBSCRIPTION - If the Distributor does not perform any annual subscription in a year, the Distributor is assumed to have resigned and the Distributor will be automatically terminated unless the Distributor notifies Shaklee in writing that he/she wishes to remain active.

GOVERNING LAW - The Distributorship will be governed by the laws of Malaysia. I/We undertake to comply all laws, rules, and regulations of Malaysia relevant to my/our Distributorship including the provisions of the Direct Sales Act, 1993, described in the Business Guide, and will indemnify Shaklee Products (Malaysia) Sdn Bhd against any violation of this agreement by me/us, however, arising.



PERSONAL DATA PROTECTION NOTICE

With reference to the Personal Data Protection Act 2010 (herein after referred to as `the Act`) that was enforced on 15th November 2013, Shaklee is ensuring that we are compliant with this Act. Pursuant to the requirements of the Act, we are now issuing this Notice to all our Independent Distributors (IDs) detailing the management of your personal data that was previously collected.

1 EXISTING PERSONAL DATA
Shaklee will process your personal data as listed, but not limited to, below, which has been provided by you to Shaklee for the furtherance of your direct selling transactions.
  • Name, Job details (designation, company) etc
  • Age, sex, date of birth, MyCard number, etc
  • Race, nationality, etc
  • Contact information, address, phone number, email address, etc
  • Marital status, family details (children and spouse`s details)
  • Photographs given to Shaklee and/or taken at official company functions, etc
  • Company registration, Bank account information, etc
(collectively hereinafter referred to as `the personal data`)

2 USAGE OF DATA
Shaklee will use and/or process the personal data for, amongst others, the following reasons.
  • Inform you of new promotions, incentives, announcements, etc
  • Delivery of products
  • Disbursement of Commissions earned.
  • Events, conventions, conference, recognitions, etc
  • Declaration in accordance to Government regulations, etc
3 DISCLOSURE OF YOUR PERSONAL DATA
Shaklee will keep your personal data confidential and will not be disclosed for any purpose other than the purpose for which the personal data was collected at the time of collection. However, on certain circumstances, your personal data may be disclosed to any other parties as stated or required by the Act.

4 SECURITY
Shaklee shall keep and process your personal data in a secure manner, where practicable, in accordance with the applicable laws and regulations to prevent the unauthorized or unlawful processing of your personal data including loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction.

5 RETENTION OF DATA
The personal data processed shall not be kept longer than is necessary after termination of contract / agreement between yourself and Shaklee. Shaklee shall take all reasonable steps to ensure that all personal data is destroyed or permanently deleted if it is no longer required for the purpose for which it was to be processed.

6 ACCESS AND CORRECTION TO YOUR PERSONAL DATA
If you would like to access, make any enquiries or change your personal data, you may do so on Shaklee Online Business Center and/or contact any of Shaklee Customer Service Representatives at Home Office and/or branches nearest you (with contact information as listed in http://www.shaklee.com.my) from time to time. Request to access or correct the personal data may be subject to a fee.

Online Ordering Agreement

Product Sales

  1. You will verify and confirm that the product(s) and order qty(s), payment method, delivery method and delivery address selected by you are correct upon order confirmation.
  2. Upon order confirmation, you authorize the company to charge your credit/debit card to pay for the said order, if you select credit card as your payment method.
  3. You agree to pay a delivery fee of RM10 if your total purchase is less than RM300. You are aware that delivery fee is waived if your total purchase exceeds RM300.
  4. After your order confirmation, you agree that the order submitted online cannot be amended, deleted or exchange with other products.
  5. You agreed that Shaklee will deliver the order to you as follow:
    1. For local / main city: estimated 4 – 5 working days from the day you placed the order online.
    2. For outstation & Sabah & Sarawak: estimated 5 – 7 working days from the day you placed the order online.
  6. Upon receiving of your order from courier service, you shall check and ensure the product(s) and qty(s) delivered to you are correct as per your order submitted. You shall contact Shaklee’s Customer Service staff within 2 working days if you found any discrepancies. Any discrepancies reported after that will not be attended.
  7. Order submitted online is not returnable or exchangeable unless the product(s) delivered to you are not as per the order submitted, having quality issue or not in consumable condition.
  8. All Independent Shaklee Distributors are free to sell to anyone who is not a Shaklee Distributor, even if that customer is being supplied by another Shaklee Distributor. However, a Distributor may not sell Shaklee products to Distributors who are sponsored outside his or her group.
  9. A Business Leader who sells to one of his or her downline Distributors must always ensure that the UV and PV associated with the transaction are properly transferred to that Distributor in the same month in which the product purchase was made.

Shaklee Guarantee

  1. The Shaklee Guarantee is one of the strongest selling points you have. As an Independent Shaklee Distributor, it is your responsibility to honor the Guarantee among consumers of Shaklee products.
  2. When a consumer seeks to avail of the Shaklee Guarantee, request he or she sign an exchange/refund receipt with the following information:
    • The reason for the exchange or refund of the product;
    • Item description, quantity, lot number, and size;
    • Monetary value of product returned/exchanged
    • Name, address and telephone number of consumer, and
    • Date of return.
  3. As soon as the consumer has signed the exchange/refund receipt, provide him/her with replacement product or refund of the price paid.
  4. In submitting the exchange/refund receipt to Shaklee, please indicate the order number, if available, under which the returned product was originally purchased from Shaklee. Shaklee will provide you with replacement product upon receipt of the returned product and the exchange/refund receipt.
  5. The Shaklee Guarantee does not apply to multiple-unit or case-quantity inventory returns, products purchased for resale, or returns of products past their expiry date.

Inventory Return and Resignation

  1. Distributors in good standing may terminate the Distributor Agreement in writing and withdraw from the Shaklee Malaysia Sales Plan at any time. Any Distributor who is considering this option should first consult his/her upline Sales Leader and Shaklee Customer Service to be fully advised of his/her current rights and obligations regarding resignation.
  2. Upon Shaklee's acceptance of your resignation as a Distributor, Shaklee will repurchase any inventory in your possession at 90% of the original purchase price. However, Shaklee reserves the right to deduct any amounts previously paid to you in connection with these transactions, as well as any reduction in the value of the returned goods. This includes any bonuses previously paid or payable to you, which will also be deducted from the repurchase amount.
  3. Returned products must be in saleable condition (un-saleable products are not accepted), and must have been purchased from Shaklee or upline and within the past sixty (60) days.
  4. Requests to return products must be made within fourteen (14) days of the Distributor's effective date of resignation. Do not return any inventory for refund before Shaklee advises you to do so; Shaklee may provide you with additional instructions. Unless Shaklee advises you otherwise, you must arrange and pay for shipping charges on returned products.

Product Return Policy – Defect Product

  1. Products are allowed to be returned ONLY upon fulfilling the following conditions:
    1. Quality issue due to manufacturing defects based on specific description ascertained by the Company, OR
    2. Product damaged (e.g. dented, leaking, broken and etc.) during transportation process, in which should be reported to Shaklee Customer Service within 2 working days from the date of receipt, except for
      • Product defect due to the negligence, mishandling or improper storage by the distributor/ customer.
      • Expired product.
  2. Product returned must be in original packing with contents not less than 80% of the packing size.
  3. Shaklee shall only accept return of defective products within 14 days from the date of purchase. All product returns must be supported by original Shaklee Receipt with the duly completed Product Exchange/Return Form with the following information:
    1. the reason for exchange
    2. item description, quantity, lot number
    3. monetary value of product returned
    4. name, address and contact number of the consumer
    5. date of product returned
  4. NO cash refund is allowed. Defective product exchange will be for product in the same value, or higher value whereby top up is required
